We are NK Burwood Pty Ltd, ABN 57 169 869 210, doing business as The Park Oasis Burwood (‘Company‘, ‘we‘, ‘us‘, or ‘our‘), a company registered in Australia at 46 Park Road, Burwood, New South Wales 2134.

We operate the website https://theparkoasis.com.au (the ‘Site‘), as well as any other related products and services that refer or link to these legal terms (the ‘Legal Terms‘) (collectively, the ‘Services‘).

This network of websites (the ‘Network’) is operated by NK Burwood Pty Ltd. ABN 57 169 869 210. Your use of any information, images and text contained on the Network (together the ‘Material’) is governed by these Terms of Use and the Privacy Policy. You acknowledge and accept that your use of the Network indicates your acceptance of these Terms of Use and the Privacy Policy.

3.3 The Park Oasis Burwood may from time to time monitor or review the contents of its Communication Facilities and reserves its right to edit, refuse to post or to remove any Materials (in whole or in part) that in The Park Oasis Burwood's sole discretion is in any way objectionable or in violation of any applicable law or these Terms of Use. The Park Oasis Burwood has no obligation whatsoever to monitor any Communication Facility or to edit, delete or refuse to post such contents, nor is The Park Oasis Burwood responsible for any contents in any Communication Facilities. You expressly acknowledge and agree that the Communication Facilities provide a means of public and not private communications.

3.4 The Park Oasis Burwood reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials which violate any applicable or relevant law.

4. USER LICENCE TO THE PARK OASIS BURWOOD

4.1 By placing any information or other material on the Network (including inputting data or engaging in any other form of communication), you grant to The Park Oasis Burwood a perpetual, royalty-free, non-exclusive, irrevocable, unrestricted, worldwide licence to do the following in respect of the information or material:

• (a) use, copy, sublicense, redistribute, adapt, transmit, publish and/or broadcast, publicly perform or display; and
• (b) sublicense to any third parties the unrestricted right to exercise any of the foregoing rights granted.

You expressly waive in favour of The Park Oasis Burwood and any other party authorised by The Park Oasis Burwood all moral rights and any similar rights in any jurisdiction which you may have or hereafter acquire in respect of any relevant communication or other material.        At the request and expense of The Park Oasis Burwood, you will execute and deliver to The Park Oasis Burwood such instruments and take such other actions as may be required to give full legal effect to this grant of licence and waiver.

5. LINKED WEBSITES

The Network may contain links to other websites operated by third parties (Third Party Websites). The Park Oasis Burwood does not endorse or approve of the operators of Third Party Websites or the material on Third Party Websites. The Park Oasis Burwood makes no warranties regarding the accuracy, adequacy or completeness of the material on Third Party Websites. Also, The Park Oasis Burwood makes no warranties that material on Third Party Websites does not infringe the intellectual property rights of any person or that reproduction of material on Third Party Websites is authorised.

6. HYPERLINKING TO THE PARK OASIS BURWOOD'S NETWORK

6.1 Unless The Park Oasis Burwood provides prior written consent, you are prohibited from:

6.2 The Park Oasis Burwood is not liable for and you must indemnify  The Park Oasis Burwood against all liabilities, claim, actions, demands, suits, costs, expenses, damage, harm or loss, including any consequential losses, suffered or incurred by  The Park Oasis Burwood arising directly or indirectly from or in connection with your use of the Network, particularly any material posted by you in breach of these terms and conditions.

6.3 Nothing The Park Oasis Burwood does or fails to do in connection with this clause 6, including failing, delaying or exercising a single or part of a right, will prejudice or operate as a waiver of The Park Oasis Burwood's rights or otherwise prevent the exercise of The Park Oasis Burwood's rights.

6.4 If The Park Oasis Burwood provides prior written consent, you must only hyperlink to the Home Page of any of The Park Oasis Burwood's Web Sites.

7. DISCLAIMER & LIMITATION OF LIABILITY

7.1 The Trade Practices Act and similar State and Territory Legislation in Australia may confer rights and remedies on you in relation to the provision by The Park Oasis Burwood of goods or services on the Network which cannot be excluded, restricted or modified (‘Non-excludable Rights’). The Park Oasis Burwood does not exclude any Non-excludable Rights but does exclude all other conditions and warranties implied by custom, law or statute.

• (d) The Park Oasis Burwood does not warrant or make any representation regarding your access to, or the results of your access to, the Network (including any related or Third Party Websites) or any Material in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.

7.3 To the fullest extent permitted by law, The Park Oasis Burwood's liability for breach of any implied warranty or condition which cannot be excluded is limited at the option of The Park Oasis Burwood to the following:

(a) in the case of services supplied or offered by The Park Oasis Burwood:

• (i) the supply of the services again; or
• (ii) the payment of the cost of having services supplied again; and
• (b) in the case of goods supplied or offered by The Park Oasis Burwood:
• (i) the replacement of the goods or the supply of equivalent goods;
• (ii) the repair of such goods;
• (iii) the payment of the cost of replacing the goods or acquiring equivalent goods; or
• (iv) the payment of the cost of having the goods repaired.

7.4 Under no circumstances (including but not limited to any act or omission on the part of The Park Oasis Burwood) will The Park Oasis Burwood, its officers, employees, agents, contractors or its related entities be liable for any direct, indirect, incidental, special and/or consequential damages, loss, claim, expense or loss of profits whatsoever which result from any use or access, or any inability to use or access, or misuse by you or any other party, of the Network or otherwise in connection with any material or the Communication Facilities.

8. INTELLECTUAL PROPERTY RIGHTS

All Material on the Network is protected by copyright and other intellectual property rights, whether registered or unregistered. The copyright is owned by The Park Oasis Burwood, companies related to The Park Oasis Burwood or third parties. No Material contained on the Network may be modified, copied, transmitted, distributed or reproduced without the prior written approval of The Park Oasis Burwood. 9. TERMINATION

These Terms of Use and your access to the Network may be terminated at anytime by The Park Oasis Burwood without notice. All restrictions, disclaimers and limitations of liability by The Park Oasis Burwood will survive termination, however, you will be no longer authorised to access the Network.

10. GENERAL

These Terms of Use are governed by and construed in accordance with the laws of New South Wales , Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales . If any provision of these Terms of Use is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms of Use, which will continue in full force and effect.
